Terms of use

These terms are a binding agreement between you and PilotMain LLC, a limited liability company formed in the State of Maryland, United States("we", "us"). By using the PilotOS website, downloading our software, or accessing linked web applications, you agree to them. If you disagree, please do not use the site or install the software.

Software is provided "as is" during beta, early access, and preview periods. We work hard to ship stable builds, but you are responsible for backing up data and evaluating fit for your use case.

Do not misuse the services—no probing, scraping, or attempts to circumvent security. Respect intellectual property in materials on this site and inside our products.

Enterprise customers may be subject to separate written agreements that override or supplement these terms where they conflict.

Disclaimer of warranties

To the fullest extent permitted by law, the site and software are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory — including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or free of harmful components.

Limitation of liability

To the fullest extent permitted by law, PilotMain LLC and its members, officers, and employees will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business interruption, arising out of or relating to your use of the site or software — whether based in contract, tort, strict liability, or any other theory, and even if we were advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to these terms or the services will not exceed the greater of the amount you paid us for the service giving rise to the claim in the twelve months before the event, or one hundred US dollars (US$100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations above apply only to the extent permitted, and nothing in these terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited.

Governing law and venue

These terms are governed by the laws of the State of Maryland, United States, without regard to its conflict-of-laws rules. You and PilotMain LLC agree to the exclusive jurisdiction and venue of the state and federal courts located in Maryland for any dispute arising out of or relating to these terms or the services, and each party consents to personal jurisdiction there. Nothing in this section removes any protection you have under the mandatory consumer laws of your country of residence.

Changes

We may update these terms as the products change. When we do, we will revise the date at the top of this page; continuing to use the services after a change means you accept the revised terms.
